Once you have your Residence Visa and been offered employment, you may make application
for a Work Permit.
If you are in Spain, you may apply at the Foreign Office (Oficinas de Extranjeros)
or the provincial office of the Ministry of Labor. (Delegacion Provincial del
Ministerio deTrabajo)
If you are outside Spain, you need to apply to the Spanish Consul in your home
country.
You will need to provide the following documents:
For an Employee:
• A copy of your valid passport.
• A Certificate of criminal records issued by the authorities in your home country.
(not required if previously presented with your application for visa.)
• Official Medical Certificate
• Three passport-size photographs. (Avoid high gloss.)
• EX-1 – Official application form signed and stamped by Employer
• EX-5 – Official job offer form signed and stamped by Employer
(n.b.must be full-time and for at least 10months) and including the work conditions
• Original Company Fiscal identity document (CIF)
• Original Company social security registration document
• TC-1 and TC-2 documents
• Certified original document from the Tesoreria General de laSeguridad Social and the Agencia Estatal de Administracion Tributaria showing company´s solvency and current with tax and social security payment obligations.
• Official certification that the position offered has been advertised in the official Provincial Employment Office with no suitable EU candidate having applied.
• A full description of the position, the company´s activities and the reason why the position should be offered to a non-European.
• Proof of professional qualifications/ credentials needed to carry out the requirements of the position.
For the Self-Employed:
• A copy of your valid passport
• A Certificate of Criminal Record issued by the authorities in your home country. (not required if previously presented with your application for visa.)
• Official Medical Certificate.
• Three passport-size photographs. (Avoid high gloss.)
• Full description of the services provided and the company activity.
• Proof of professional qualifications, licences, registration with Spanish Social Security system, NIE number.
• Additional documentation that may be required by the Spanish authorities.
This list is the most detailed we could find. Please note that the Spanish Administration may have additional requirements and you may find the services of a Spanish Lawyer, a worthwhile investment. It will save a lot of time and frustration, spent in queues. Be aware that there is no legal right to a work permit. The Provincial Labor Office (Direcciones Provinciales de Trabajo, Seguridad Social y Asuntos Sociales) decides whether or not the work permit is issued or not.
To remain in Spain longer than three months you must obtain an extension or a Residence Permit. Application must be made, in person to the Foreigners’ Office (Oficina de Extranjeros) or to the National Police with a foreigner´s department, nearest to the city or town where you are to reside.
